Crystal Weather — Terms of Service

These Terms of Service ("Terms") are an agreement between you and Alexander Ross, operating Crystal Weather ("Crystal Weather," "we," "us," "our"), governing your use of the Crystal Weather mobile application (the "App").

By using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Who These Terms Cover

These Terms apply to everyone who uses Crystal Weather, whether or not you have an account. That includes guests who use the App to view local conditions without signing up.

• You must be at least 13 years old to use the App, with or without an account.
• An account is required to post. Guests can view local conditions but cannot create reports, comment, like, or add friends.

2. Your Account

• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You agree to provide accurate information when creating your account.
• You may not create an account on behalf of another person without their permission, or impersonate any person.
• We may suspend or terminate accounts that violate these Terms.

3. Your Content

3.1 Ownership

You own the photos, posts, comments, and other content you create and share on Crystal Weather ("Your Content").

3.2 License to Us

So that we can operate the App, you grant Crystal Weather a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute Your Content solely for the purpose of operating and providing the App — for example, storing your photos, showing your posts to your friends or, where you choose, on the Local feed, and including excerpts of your content in notifications sent to the users your content is directed at. This license ends when you delete Your Content or your account, except where your content has been shared with others and they have not deleted it, or where retention is required by law.

We do not use Your Content for advertising, and we do not sell Your Content.

3.3 Anonymous and Aggregated Use

You also grant us the right to use the weather observations in your reports in anonymous, aggregated form — combined with other people's reports and stripped of anything identifying you — including in the public local summary described below and in our Privacy Policy. This right survives deletion of Your Content, because aggregated data cannot be traced back to any individual report.

3.4 Visibility and the Local Summary

Your posts are visible only to your accepted friends by default. You may choose, per post, to make a post public, in which case it appears on the Local feed for users in your area. Location displayed with your posts is reduced in precision as described in our Privacy Policy.

Important: all reports, including friends-only ones, count toward an anonymous local summary that anyone can see, including people without an account. The summary never includes names, photos, or captions, and nothing is shown for an area with fewer than 3 reporters. Our Privacy Policy explains this in full. You are responsible for the visibility choices you make.

3.5 Content Standards

You agree not to post content that:

• Is illegal, or promotes illegal activity
• Harasses, threatens, bullies, or abuses any person
• Contains nudity or sexually explicit material
• Infringes any person's intellectual property, privacy, or publicity rights
• Impersonates any person or misrepresents your affiliation with anyone
• Contains spam, malware, or unauthorized commercial content
• Reveals another person's private information without their consent
• Is deliberately false or intended to distort local conditions reported by others

3.6 Moderation and Removal

We may remove any content that violates these Terms, and may suspend or terminate the responsible account, at our discretion and without prior notice. We are building out reporting and blocking tools; in the meantime, you can report any content or conduct by emailing [email protected], and we will review promptly.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to access another user's account or data
• Scrape, harvest, or collect data from the App or our API by automated means, including bots, scripts, crawlers, or any automated client
• Circumvent, disable, or work around rate limits, access controls, or any other technical measure we use to protect the service
• Reverse-engineer our API endpoints, or probe, scan, or test the vulnerability of the App or its infrastructure without authorization
• Access the App through anything other than the official Crystal Weather application, unless we authorize it in writing
• Interfere with or disrupt the App's operation, or impose an unreasonable load on our infrastructure
• Submit false reports at scale, or otherwise manipulate the local summary
• Use the App to stalk, track, or harm any person, including through the use of location information
• Use notifications, comments, friend requests, or other interactions to harass or spam another user
• Reverse engineer, decompile, or attempt to extract the source code of the App

5. Notifications

If you enable push notifications, we will send them when another user interacts with you directly — sending you a friend request, accepting your friend request, liking your post, or commenting on your post. We do not send promotional or marketing notifications.

You can turn notifications off at any time in the App's Settings or through your device's system settings. This control is per device. See our Privacy Policy for details on what notification content includes and how it is transmitted.

6. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on Crystal Weather infringes your copyright, send a notice to [email protected] with the subject line "DMCA Notice," including:

1. Identification of the copyrighted work you claim is infringed
2. Identification of the material you claim is infringing and where it appears in the App
3. Your name, address, email, and phone number
4. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
6. Your physical or electronic signature

We will review and act on valid notices, including removing infringing material and, for repeat infringers, terminating accounts.

7. Weather Information Disclaimer

Reports on Crystal Weather — including "feels like" impressions, outfit information, and condition tags — are people's own subjective impressions. They are unverified, we do not check them for accuracy, and they are not a weather service. The local summary is a count of what users have reported, not a measurement. Forecast data shown in the App comes from third-party weather services and may be inaccurate or delayed.

Do not rely on Crystal Weather for safety decisions. For severe weather warnings and emergency information, follow official sources such as the National Weather Service.

8. The App Is Provided "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT NOTIFICATIONS WILL BE DELIVERED RELIABLY OR ON TIME, OR THAT ANY WEATHER INFORMATION IN THE APP IS ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYSTAL WEATHER AND ALEXANDER ROSS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED FIFTY DOLLARS ($50).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Crystal Weather and Alexander Ross from any claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the App, or your violation of these Terms or of any third party's rights.

11. Termination

You may stop using the App and delete your account at any time through the App's Settings. We may suspend or terminate your access at any time for violation of these Terms or to protect the App and its users. Sections 3.2 and 3.3 (to the extent stated there), and 6 through 15, survive termination.

12. Our Intellectual Property

The App — including its design, branding, logos, and underlying software — is owned by Alexander Ross and protected by intellectual property laws. These Terms do not grant you any right to use the Crystal Weather name, logo, or branding.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version with a new "Last Updated" date, and if changes are material, we will provide notice within the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising from these Terms or the App shall be brought in the state or federal courts located in Illinois, and you consent to the jurisdiction of those courts.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
